POLK COUNTY, Fla. – Two Delaware residents face criminal charges after an argument over a smoke shop’s return policy escalated into theft Tuesday evening in Davenport, according to the Polk County Sheriff’s Office.

Deputies responded around 7:30 p.m. on August 25 to Skywalker Smoke Shop, located at 162 California Boulevard, following a report of a retail theft.

According to store staff, 25-year-old Mercedes Lynn Ferrell of Wilmington, Delaware, bought an item and left the store before returning shortly after to request a refund. An employee told Ferrell that the shop maintains a strict no-return policy and denied the request.

Deputies said Ferrell then contacted someone on her phone. Moments later, 30-year-old Dominic Toney, also of Wilmington, walked into the business.

The employee told deputies that Toney said to Ferrell, “You already paid for one item, just grab one and let’s go!”

When the worker reiterated that exchanges are not allowed, Toney responded, “No exchange? I’ll exchange this whole store upside down.”

Toney then took unpaid merchandise from the shelves. Both Toney and Ferrell left the building and drove away in a Jeep Compass bearing Minnesota license plates.

Deputies located the vehicle shortly after, initiated a traffic stop, and took both individuals into custody without further incident.

Toney and Ferrell were booked into the Sheriff’s Processing Center. Both have been charged with first-degree misdemeanor retail theft and second-degree misdemeanor conspiracy to commit petit theft.
